Different Classes of Felonies

In Illinois, felony state crimes are classified into five separate categories. These categories, called classes, carry different types of consequences upon conviction. They range from Class 4, which is the least severe categorization, to Class X, which encompasses the most serious crimes.

  • Class 4: These are the least serious felonies but still carry punishments of one to three years in prison, with the potential for being sentenced to three to six years.
  • Class 3: Class 3 felonies are punishable by a minimum of two years and up to five years in prison and possibly an additional five to 10 years.
  • Class 2: A Class 2 felony is the middle ground of the felony classes, with a conviction requiring incarceration for three to seven years, and an additional possibility of seven to 14 years.
  • Class 1: If convicted on a Class 1 felony, you will be facing a sentence of four to 15 years in prison, with the possible extension of 15-30 years.
  • Class X: As the most serious of all crimes, Class X crimes carry a mandatory minimum punishment of six to 30 years in prison. If the crime is egregious enough, there may be an extension, placing the offender in prison for 30-60 years.

First-degree murder is even more serious than a Class X felony and as such is charged on its own, with the accused facing 20 to 60 years, and possibly life, in prison. Illinois no longer uses the death penalty.
